These Terms & Conditions ("Terms") govern your access to and use of the NFCBiz website (the "Site") and the purchase of any NFCBiz Review Cards or related products ("Products"). By placing an order or using our Site, you agree to be bound by these Terms. Please read them carefully.
1. About Us
NFCBiz ("we", "us", or "our") is a United Kingdom-based business that sells NFC-enabled review cards designed to help businesses collect Google reviews. You can contact us at info@nfcbiz.com.
2. Eligibility
By using our Site or purchasing our Products, you confirm that you are at least 18 years old and legally able to enter into a binding contract.
3. Orders & Acceptance
Placing an order through our checkout is an offer by you to purchase Products from us. Your order is accepted, and a binding contract is formed, when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including (without limitation) cases of suspected fraud, pricing errors, or stock issues.
4. Pricing & Payment
- All prices are shown in the currency listed on the Site and include applicable VAT where indicated.
- Shipping costs (if any) are calculated and displayed at checkout before you confirm your order.
- Payment is taken in full at the time of order via our payment processor (Stripe). We do not store your card details.
- If a pricing error is discovered after your order is placed, we will contact you and you may either confirm the corrected price or cancel for a full refund.
5. Shipping & Delivery
We typically dispatch UK orders within 1–2 business days. Estimated delivery times shown at checkout are indicative only and we are not responsible for delays caused by carriers, customs, or other events outside our reasonable control. Risk in the Products passes to you upon delivery.
6. Right to Cancel & Refunds
If you are a consumer in the UK or EU, you have a statutory right to cancel your order within 14 days of receiving the Products and return them for a refund, provided they are unused and in their original packaging. To exercise this right, email info@nfcbiz.com with your order number. You are responsible for the cost of return shipping unless the Products were faulty or incorrectly supplied.
Custom-printed or personalised Products (for example, cards printed with a specific business name or QR code) are exempt from the standard 14-day cancellation right unless they are faulty.
7. Faulty or Damaged Products
If your Product arrives faulty, damaged, or not as described, please contact us within 30 days of delivery. We will arrange a replacement or refund at no cost to you in line with your rights under the Consumer Rights Act 2015.
8. Acceptable Use
You agree not to:
- Use our Products to solicit fake, incentivised, or misleading reviews in breach of Google's policies.
- Resell our Products without our prior written consent.
- Reverse-engineer, tamper with, or repurpose our NFC chips for unlawful purposes.
- Use our Site to transmit malware, spam, or unlawful content.
We reserve the right to disable a card's linked URL or refuse future service if these terms are breached.
9. Intellectual Property
All content on this Site, including text, graphics, logos, images, and software, is the property of NFCBiz or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute any content without our prior written permission. The "NFCBiz" name and logo are trademarks of NFCBiz.
10. Third-Party Services
Our Products direct customers to Google review pages. We are not affiliated with Google and are not responsible for Google's availability, policies, or any changes to its review system. Similarly, our checkout uses Google Places to help you find your business; usage is subject to Google's terms.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms or the Products is limited to the amount you paid for the relevant Product. We are not liable for any indirect, incidental, or consequential losses, including loss of profits, revenue, business opportunities, or reviews.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
12. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your personal data.
13. Changes to These Terms
We may update these Terms from time to time. The version that applies to your order is the version published on the Site at the time you placed it. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident elsewhere in the UK or EU, in which case mandatory local laws continue to apply.
